ABOUT FTM
FTM Agency, Ltd was born in 1990 as a literary department within the legal firm FTM Entertainment, Ltd. Later the literary department separated from the mother company and became an independent legal entity. At present, FTM Agency mainly works along the following three lines: Russian classics, contemporary Russian authors and playwrights, translators of world literature, and illustrators.
Currently FTM represents the rights and interests of more than 150 authors who are looked after by four experts. Relationships between FTM and the rights-holders (authors and successors) are based on an agent agreement, appointing FTM as the sole literary agent and legal representative of the rights-holder. This agreement is in full keeping with the relevant articles of the Civil Code of the Russian Federation (see Chapter 52).
Having signed the agreement for representation the copyright-holder appoints FTM to conduct all further negotiations in his/her name with the rights-users (publishers, film-makers, TV and radio companies). FTM draws corresponding contracts, gets them signed and supervises their correct execution. In the case of a breach of their clients' contracts, FTM defends their rights in every way, including taking the matter to court. The Agency's staff includes experienced lawyers, dealing with court cases and lodging claims. In complicated cases, requiring a larger team of lawyers, FTM resorts to the assistance of its main patron: the legal firm FTM Entertainment, Ltd which is providing legal and consulting services to Russian and foreign organizations and private persons concerning copyright matters in all fields of literature and art.
FTM works not only in the Russian market but in the foreign markets as well, including the countries of the CIS. FTM actively promotes Russian authors abroad. Some of the FTM lawyers specialize in international law and have a good knowledge of foreign languages. Consequently, all correspondence and negotiations with foreign rights-users are conducted on a high professional level, ensuring equal footing for the users and the right-holder alike. In order to broaden the range of their activities and acquire new partners among foreign publishers and agents, FTM takes part in Book Fairs with the aim of establishing long-term cooperation with them.
We welcome new clients, both authors and their successors, who need our help and expertise. However, there is a number of internationally-accepted rules and conditions that the Agency follows:
- Not only the author has the right to choose the agent, but the agent also has the right to choose clients;
- The Agency does not assume full responsibility, and neither does it guarantee that any of the works submitted to them will be in demand. Success is largely determined by the literary, historical, commercial and other qualities of the text rather than the agent's efforts;
- The agent agreement is signed for three years during which the rights-holder assumes the responsibility to conduct his/her affairs only through the agency;
- The agent's commission is 15% from the general sum of the signed contract.
